Terms and Conditions of EXP 28
Welcome to EXP 28! These Terms and Conditions ("Terms") govern your use of our website, exp28.com (the "Site"), as well as your purchase of 3D printed products ("Products") offered by our company. By accessing the Site and purchasing our Products, you agree to comply with these Terms. Please read them carefully.
1. General
Acceptance of Terms: By using this Site, you confirm that you are of legal age to enter into binding contracts in your jurisdiction, or that you have obtained parental or guardian consent.
Changes to Terms: We reserve the right to modify these Terms at any time. Any changes take effect immediately upon posting on the Site. Continued use of the Site after changes constitutes your acceptance of the updated Terms.
Privacy Policy: Our Privacy Policy also applies to your visit to the Site and is incorporated into these Terms.
2. Products and Orders
Product Descriptions: We strive to describe products accurately. However, due to the nature of 3D printing, slight variations in color, texture, or finish may occur. Images are for illustrative purposes only. We do not guarantee complete accuracy, currency, or reliability of descriptions.
Order Acceptance: All orders are subject to approval. We reserve the right to refuse or cancel any order for any reason, including product availability, description or pricing errors, or issues identified by our fraud prevention systems.
Custom Projects: If you submit your own 3D model ("Customer Project"), you are solely responsible for its content and specifications.
Pricing and Payment: All prices are listed in EUR and may change without notice. The price applied will be the one in effect at the time of purchase. Payment must be made in full at checkout. We accept various payment methods via Shopify and PayPal. All information provided must be accurate and complete.
3. Shipping and Delivery
Shipping: Products will be shipped to the address provided during purchase. Shipping costs and estimated delivery times will be shown at checkout.
Risk of Loss: Risk and ownership of the Products transfer to you once they are delivered to the carrier.
Production Time for Painted Figures: All painted products are made to order, with an estimated production time of 3 to 4 weeks, which may vary depending on order volume. We strive to meet these timelines, and in case of any delays, we will notify you in advance.
Order Status: You can check your order status at any time in your account.
3.1 Taxes, Fees, and Customs Clearance (for all deliveries outside Portugal)
We cover taxes and customs fees only for painted product orders.
For all other international shipments, you may be responsible for import taxes, duties, or brokerage fees charged by local authorities or the carrier. These fees are not included in our prices or shipping costs unless explicitly stated.
3.2 Shipping to the USA
As of August 29, 2025, the low-value exemption ("de minimis") has been suspended. All shipments from Portugal to the USA may be subject to taxes/fees regardless of order value. Orders are shipped DAP, and you are responsible for any charges applied by U.S. customs or the carrier.
3.3 Deliveries within the European Union
For EU deliveries, no customs duties apply. VAT will be charged according to distance-selling rules (OSS/IOSS). Any local handling fees, if applicable, are your responsibility unless otherwise stated.
3.4 Deliveries in the United Kingdom
For orders up to £135, UK VAT is generally collected at checkout, and import duties typically do not apply. For orders above £135, import VAT and any applicable fees may be charged upon delivery by the carrier or HMRC.
4. Returns, Refunds, and Cancellations
Right of Withdrawal: Customers in the EU or UK have the legal right to withdraw from the contract within 14 days without providing a reason.
Withdrawal Period: The 14-day period starts from the day you, or a third party indicated by you, receive the goods.
How to Exercise: Notify us clearly before the withdrawal period ends (e.g., by email or mail). Use of the standard legal form is optional.
Effect of Withdrawal: We will refund all payments, including standard shipping costs, within 14 days after receiving the returned products or proof of shipment.
Refund Method: Refunds will be made using the same payment method unless otherwise agreed.
Return Conditions: Products must be returned within 14 days after notification. You are responsible for return shipping unless stated otherwise.
Exceptions: Does not apply to customized products, perishable items, sealed goods not suitable for return for health/hygiene reasons once opened, or digital purchases delivered immediately.
Defective Products: Contact us within 3 days of receiving a defective product. If confirmed, you may receive repair, replacement, or refund.
Cancellations: May be possible depending on order status, with restocking fees from 10% to 60%. Shipped orders cannot be canceled.
5. Intellectual Property
Site Content: All content on this Site is owned by EXP 28 or licensed suppliers, protected by intellectual property laws.
Designs: Designs sold remain the property of EXP 28. Purchase grants a license to use the physical product but does not transfer design rights.
Customer Projects: You guarantee that you hold all rights to submit your designs. EXP 28 is granted a non-exclusive, worldwide, royalty-free license to use the design solely for fulfilling your order.
No Reverse Engineering: You may not decompile or reproduce products without authorization.
6. User Conduct
You agree not to use the Site or Products for illegal purposes, to harm the Site, or to attempt unauthorized access to any systems.
7. Disclaimers and Limitation of Liability
"As Is": Site and Products are provided "as is," without warranties, express or implied.
3D Printed Products: Products may vary in finish and structural properties. Generally intended for decorative or personal use.
Limitation of Liability: EXP 28 is not liable for indirect, incidental, or consequential damages, including lost profits or data. Maximum liability is limited to the amount paid for the Products.
8. Indemnification
You agree to indemnify and hold EXP 28 and its affiliates harmless from any third-party claims arising from your violation of these Terms or the rights of others.
9. Governing Law
These Terms are governed by the laws of Portugal.
10. Severability
If any provision is deemed invalid or unenforceable, it will be separated without affecting the validity of the remaining provisions.
11. Entire Agreement
These Terms, along with any policies or rules posted on the Site, constitute the complete agreement between you and EXP 28, superseding prior communications.
